
RxDC Reporting: Annual Compliance Obligation for GHPs
Employer-sponsors are no longer required to distribute Forms 1095-B and 1095-C to full-time employees and any covered individuals for the 2024 ACA reporting year and beyond. Now, employer-sponsors need only make these forms available upon a request by an individual. Upon request, the form must be provided by the later of either January 31 of the year following the calendar year to which the return relates or 30 days after the date of the request.

New Indemnity Plan Notice Requirement
Earlier this year, the U.S. Departments of Labor, Treasury, and Health and Human Services issued final rules on certain types of health coverage not subject to the Affordable Care Act’s (ACA’s) consumer protections. The final rules include a new notice requirement for hospital and fixed indemnity plans offered in the group market. Effective for plan or policy years beginning January 1, 2025, employer-sponsors and carriers are subject to a new employee notice requirement for these hospital or fixed indemnity plans.
