DOL Issues Model Notices to Aid Employers in Their Compliance Obligations Under ARPA’s COBRA Subsidy Provision

One of the provisions in the American Rescue Plan Act of 2021 (ARPA) includes a 100% fully subsidized COBRA premium for certain individuals beginning on April 1, 2021 and ending on September 30, 2021 (subsidy period). Employers must timely notify individuals who become entitled to elect COBRA during the subsidy period of the subsidy’s availability and the option to enroll in different coverage (if permitted by the plan) by May 30, 2021. In addition, employers must notify individuals of their subsidy’s expiration between 45 and 15 days before the expiration date.

COVID-19 Exchange Special Enrollment Period Extended

On March 23, 2021, CMS announced that it is extending a special enrollment period through the Exchanges due to the coronavirus (COVID-19) pandemic. As a result, eligible individuals have three additional months, through Aug. 15, 2021, to enroll in Exchange coverage via HealthCare.gov. California Updates COVID-19 Supplemental Paid Leave Statute

Beginning on March 29, 2021, Senate Bill 95 (SB 95) required employers to begin providing additional supplemental paid sick leave to employees because of COVID-19. SB 95 is much more robust than its predecessor, AB 1867. It expands the number of employees eligible for COVID-19 paid sick leave, expands the reasons an employee may take paid sick leave, and applies retroactively to January 1, 2021, which will require some employers who previously granted employees unpaid leave for COVID-19 related reasons to retroactively compensate those employees.
