On January 13, 2022 the U.S. Supreme Court (Supreme Court) issued a stay on the enforcement of the Occupational Safety and Health Administration’s (OSHA) 100+ Employee Vaccination and Testing Emergency Temporary Standard (ETS). The Supreme Court’s stay follows oral arguments that were held Friday, January 7, 2022 to determine if the ETS as well as the separate CMS vaccine mandate should again be stayed pending full review of the merits of the respective litigation. The Supreme Court’s stay effectively blocks the OSHA ETS by making it currently unenforceable until a final legal decision is made by the U.S. Sixth Circuit Court of Appeals.
