The ACA requires health insurance issuers and self-insured plan sponsors to pay PCORI fees. While these fees are generally paid by July 31 annually, the deadline for plan years ending in 2020 is Aug. 2, 2021, since July 31, 2021, is a Saturday. On July 1, 2021, the Departments of Labor, Treasury, and Health and Human Services (the Departments) released Part One of the regulations addressing the highly anticipated No Surprises Act (the Act), which was introduced in December 2020 as part of the Consolidated Appropriations Act, 2021 (CAA). These interim final rules of the Act are just the first in a series of guidance that can be expected this year. However, according to the Departments, the set of regulations for the transparency requirements under the Act might be delayed until 2022.
